1. Acceptance of Terms
By creating an account, signing up, or making a booking through the app, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Skyline Villa.
2. Service Description
Emerald by Skyline Villa provides a mobile platform for users to view, reserve, and manage bookings for our luxury rental property located in Naivasha, Kenya. The property includes a 4-bedroom Main House and a 1-bedroom Detached Unit, along with various amenities and services.
3. User Eligibility
You must be at least 18 years of age to create an account and make bookings. By using the app, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
4. Account Responsibilities
- You are responsible for providing accurate, current, and complete information during registration and identity verification.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
5. Booking Terms
- Check-in Time: From 2:00 PM onwards.
- Check-out Time: By 10:00 AM.
- Late Check-out: Subject to availability and prior request; additional charges may apply.
- Guest Conduct: Guests are expected to behave in a manner that is respectful of the property and neighbors. Any illegal activity or conduct that disturbs the peace may result in immediate eviction without refund.
6. Cancellation Policy
Our cancellation policy is designed to be fair to both guests and property management:
- 14+ days before check-in: Full refund minus any non-refundable service fees.
- 7-13 days before check-in: 50% refund of the total booking amount.
- Less than 7 days before check-in: No refund will be issued.
- No-shows: No refund will be issued for guests who do not arrive.
- Exceptional circumstances: At our sole discretion, we may consider refunds for verified medical emergencies or other extenuating circumstances.
7. Payment Terms
- Payment Processor: All payments are securely processed via our payment partner.
- Currency: All transactions are conducted in Kenya Shillings (KES).
- Methods: We accept M-Pesa and major Credit/Debit cards.
- Refunds: Approved refunds will be processed back to the original payment method. Processing times may vary.
8. Property Rules
To ensure a premium experience for all guests:
- No Smoking: Smoking is strictly prohibited inside any buildings. Designated outdoor areas are available.
- Quiet Hours: Please observe quiet hours from 10:00 PM to 7:00 AM.
- Registered Guests: Only guests registered at booking are permitted overnight.
- Visitors: Daytime visitors require prior approval from management.
- No Parties: Large events or parties are prohibited without explicit written consent.
- Damages: Any damages must be reported immediately. Significant damages will be charged to the guest.
- Conservation: Please conserve resources by turning off lights and electronics when not in use.
9. Limitation of Liability
To the maximum extent permitted by the laws of Kenya, Skyline Villa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues resulting from:
- Your use or inability to use the app or services.
- Unauthorized access to or use of our servers.
- Any personal injury or property damage resulting from your stay at the property.
10. Intellectual Property
All content, branding, logos, and software used in the app are the exclusive property of Skyline Villa or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from the app without our express written permission.
11. Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Dispute Resolution
In the event of a dispute, we encourage you to contact us directly to seek a resolution.
- Mediation: If a dispute cannot be resolved informally, it shall be submitted to mediation in Nairobi, Kenya.
- Litigation: If mediation fails within 30 days, the matter shall be referred to the exclusive jurisdiction of the courts of Nairobi, Kenya.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. Users will be notified of significant changes via the app. Your continued use of the app following the posting of changes constitutes your acceptance of such changes.

16. Severability
